Knoxville Implied Consent / DUI Attorney


A person charged with DUI or Driving Under the Influence in Tennessee will be charged with an Implied Consent Violation if the driver refuses to submit to a blood or breath test when requested by a police officer.  The police officer decides whether it will be a breath test or whether the driver has to have blood drawn.  The driver does not have a choice.


The Tennessee Implied Consent Law, T. C. A. § 55-10-406, requires anyone who drives a motor vehicle in Tennessee to submit to a chemical test to determine the alcohol or drug content of the driver’s blood when asked to by a law enforcement officer.  Although a driver has a right to refuse the test, this can result in the revocation of your driver’s license for 1 to 5 years and mandatory jail time based on the circumstances.
