Boating in Knoxville and surrounding counties is a very popular summer activity. Fort Loudon Lake, Norris Lake, Douglas Lake, Cherokee Lake and Watts Bar Lake are all popular destinations in Knoxville and the surrounding vicinity. BUI or Boating Under the Influence charges are also very common in Knoxville and east Tennessee.
In Tennessee, it is illegal for “any person or persons to operate any vessel subject
to registration or any commercial vessel as defined in this section on the public
waters of the state while under the influence of any intoxicant, marijuana, narcotic
drug, or drug producing stimulating effects on the central nervous system.” T.C.A.§

Like a DUI, a BUI or Boating Under the Influence charge has serious consequences. A conviction can result in a fine from $250.00 to $5,000.00. You can be sentenced to a mandatory 30 days in jail up to 11 months and 29 days. Your boating license can be suspended from 1 year up to 10 years.
In most Tennessee BUI cases, the arresting agency is the Tennessee Wildlife Resources Agency (TWRA). Tennessee Boating Under the Influence cases present unique challenges. A Tennessee attorney experienced in BUI, DUI and alcohol or drug related cases will investigate the case and challenge the prosecutor’s case. A successful outcome often depends on convincing the judge or jury that the officer’s testimony is not reliable.
